Terms of Service

The Service is for healthcare professionals, their staff and the healthcare organizations they work for. You must be at least 18 years old and able to form a binding contract.

• You sign in with a third-party account, such as a Google account. Provide accurate information when you set up your profile and keep it up to date.
• New referral portal accounts are reviewed by fortecare before they can send referrals. We may approve, decline, suspend or revoke an account at our discretion, for example if we cannot verify who you are or which clinic you work for.
• You are responsible for activity under your account. Keep your sign-in secure, do not share it, and tell us promptly at contact@fortecare.ai if you believe it has been used without your permission.

• Only submit patient information that you are authorized to share for the patient’s treatment and care coordination, and only what is needed for the referral.
• You are responsible for obtaining any consents or authorizations the law or your organization requires before you share patient information through the Service.
• Check that the information and documents in a referral are accurate and complete, and are for the right patient, before you submit it.

We handle patient information as described in our Privacy Policy and in any agreement we have with your organization.

The Service helps organize referrals and supports clinical and administrative workflows. It does not provide medical advice, diagnosis or treatment. Automated or AI-generated output, such as summaries, classifications or suggested urgency, may be incomplete or wrong and must be reviewed by a qualified professional. Clinical decisions remain the responsibility of the treating and receiving clinicians.

The Service is not for emergencies. If a patient needs urgent care, contact the receiving clinic directly or call emergency services.

You agree not to:

• use the Service for anything unlawful, or in violation of patient privacy laws;
• access, or try to access, information or accounts you are not authorized to use;
• submit false or misleading referrals or profile information, or impersonate anyone;
• upload malware or content that could harm the Service or other users;
• interfere with, disrupt, probe or test the security of the Service, or bypass its access controls;
• copy, scrape, reverse engineer or build a competing product from the Service, except where the law does not allow this restriction.

You and your organization keep your rights in the information and documents you submit. You give fortecare permission to host, process, transmit and display that content only as needed to provide, secure and support the Service, and as described in our Privacy Policy. If you send us feedback or suggestions, we may use them without obligation to you.

The Service, including its software, design and content, belongs to fortecare and its licensors and is protected by law. Subject to these Terms, we give you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.

The Service relies on third-party services, such as Google for sign-in. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

We may change, add or remove features of the Service. We work to keep the Service available and reliable but do not guarantee it will be uninterrupted or error-free, and it may be unavailable during maintenance.

You may stop using the Service at any time. We may suspend or end your access if you break these Terms, if your organization’s access ends, or if needed to protect patients, users or the Service. Sections that by their nature should survive, including those on content, disclaimers and limitation of liability, continue after termination. Records we are required to keep will be retained as described in our Privacy Policy.

Except as expressly stated in a written agreement with your organization, the Service is provided “as is” and “as available”, and fortecare disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, fortecare will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from or related to the Service. fortecare’s total liability for any claim related to the Service is limited to the greater of the amount you paid fortecare for the Service in the twelve months before the claim and one hundred US dollars. Some jurisdictions do not allow these limits, so they may not fully apply to you.

You agree to defend and indemnify fortecare against claims arising from your misuse of the Service, your violation of these Terms, or patient information you submit without proper authorization, to the extent permitted by law.

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date and let account holders know of material changes. Continuing to use the Service after the changes take effect means you accept them.
